TERMS & CONDITIONS

These Terms & Conditions ("Terms") apply to all natural or legal persons ("User") who visit www.kaila.design ("Site") operated by Kaila Design ("Company" or "Kaila Design") and/or benefit from the services offered through the Site. Anyone who accesses and uses the Site is deemed to have accepted these Terms.

1. SCOPE 1.1. These Terms regulate the general provisions regarding the use of the Site and the products and services offered through the Site. 1.2. Supplementary documents such as the Privacy Policy, Clarification Text on the Protection of Personal Data (KVKK), Distance Selling Agreement, and Returns & Exchanges Policy are an integral part of these Terms. By using the Site, the User agrees to comply with these supplementary documents.

2. ACCEPTANCE AND AMENDMENTS 2.1. By accessing or using the Site in any way, the User declares that they have read, understood, and accepted these Terms. 2.2. The Company reserves the right to amend these Terms at any time. Updated Terms shall enter into force on the date they are published on the Site and shall be binding for all users accessing the Site thereafter.

3. SERVICES AND PRODUCTS 3.1. Kaila Design is an e-commerce platform selling clothing and accessories. All products, services, and content offered through the Site are provided on an "as is" basis; the Company makes no warranties regarding their accuracy, completeness, or fitness for a particular purpose. 3.2. The Company reserves the right to change product stock status, price information, or promotional campaigns without prior notice. Visuals, promotions, and descriptions on the Site are for general informational purposes only.

4. USER OBLIGATIONS 4.1. The User is obligated to act in accordance with applicable legislation and public morality in all transactions made through the Site. The User may not share misleading, incorrect, or infringing content that violates the rights of third parties. 4.2. All content and comments transmitted by the User through the Site are entirely the responsibility of the User. 4.3. The User is responsible for the internet, device, and technical infrastructure required to access the Site.

5. INTELLECTUAL PROPERTY RIGHTS 5.1. Unless otherwise stated, all content on the Site (text, images, logos, designs, software, etc.) belongs to the Company and is protected in accordance with national and international law. 5.2. Without the written permission of the Company, the User may not copy, reproduce, distribute, or use the content on the Site for commercial purposes.

6. PRIVACY AND PROTECTION OF PERSONAL DATA 6.1. Personal data shared by the User on the Site is processed in accordance with the Law on the Protection of Personal Data No. 6698 (KVKK) and other relevant legislation. 6.2. Details are regulated within the "Privacy Policy" and "Clarification Text on the Protection of Personal Data."

7. LIMITATION OF LIABILITY 7.1. The Company is not responsible for any technical failures, interruptions, errors, or data loss that may occur during the use of the Site. 7.2. The Site may contain links to third-party websites. The Company is not responsible for the content or practices of these sites. 7.3. The Company cannot be held liable for any delay or impossibility of performance caused by force majeure events (natural disasters, fire, war, strikes, cyberattacks, etc.).

8. GOVERNING LAW AND JURISDICTION 8.1. These Terms are governed by the laws of the Republic of Türkiye. 8.2. In the event of any dispute arising from the implementation of these Terms, the courts and enforcement offices of Mersin shall have exclusive jurisdiction.

9. EFFECTIVENESS AND ACCEPTANCE 9.1. These Terms become effective on the date they are published on the Site. 9.2. All Users who continue to use the Site are deemed to have accepted these Terms.

PURPOSE AND SCOPE This Privacy Policy explains the principles regarding the collection, storage, processing, and transfer of users' personal data within the framework of our atelier and online sales platforms operating under the Kaila Design brand. The procedures and principles regarding the processing of personal data of our customers, users, and visitors are conducted within the framework of the Personal Data Protection Law (KVKK) No. 6698 and the provisions specified in this Privacy Policy.

  • Payment and Billing Information: Billing address, payment method information (credit card data is processed via payment providers and is not stored by us)

  • Custom Design Processes: Measurements provided by the customer, design preferences, notes

  • Fulfilling official institution requests and meeting legal obligations

  • Executing accounting, finance, billing, and tax processes

  • Preventing fraud and ensuring security

METHODS OF COLLECTING PERSONAL DATA Kaila Design may collect your personal data through the following methods:

  • Order and payment processes via online sales platforms (Shopier, Trendyol, etc.)

  • Social media and communication channels (Instagram, WhatsApp, e-mail, etc.)

  • Physical environment (atelier, delivery, and return processes)

LEGAL BASIS FOR PROCESSING PERSONAL DATA Your personal data is processed based on legal grounds such as:

  • Establishment or performance of a contract (product order and delivery),

  • Fulfillment of legal obligations (tax, accounting),

  • Platform providers (Shopier, Trendyol, server and infrastructure services). Personal data is under no circumstances shared with third parties for marketing purposes.

STORAGE PERIOD OF PERSONAL DATA Kaila Design stores your personal data for the period stipulated in the relevant legislation and as long as the order and billing relationship continues. When the period expires, the data is deleted, destroyed, or anonymized.

DATA SECURITY Kaila Design applies necessary administrative and technical measures to ensure the confidentiality of your personal data:

  • Secure payment infrastructure,

  • Encryption and access restrictions,

  • Regular security checks.

COOKIE POLICY Cookies may be used when visiting the Kaila Design website to improve user experience. Users can limit or block the use of cookies through browser settings. However, in this case, some features may have limited functionality. (Transactions made via Shopier and Trendyol are subject to the respective platforms' own cookie policies.)

USER RIGHTS Pursuant to Article 11 of the KVKK, personal data owners have the right to apply to Kaila Design to:

  • Learn whether personal data is processed,

  • Request information if it has been processed,

  • Learn the purpose of processing and whether it is used in accordance with its purpose,

  • Know the third parties to whom data is transferred,

  • Request correction of incomplete or incorrectly processed data,

  • Request deletion or destruction of data within the framework of conditions stipulated in the KVKK,

  • Request notification of these transactions to third parties,

  • Object to a situation that arises against the person as a result of analysis exclusively by automated systems,

  • Demand compensation for damages in case of loss due to illegal processing of data.

CHANGES Kaila Design reserves the right to make changes to this Privacy Policy whenever it deems necessary. Updates become effective immediately upon publication on the website.
